Bidding and Administrative Contracts

The book Bidding and Administrative Contracts by professor Henrique Savonitti was the first of his works that was approved and published by the Editorial Board of the Federal Senate.

The book, released on June 19th, 2004, included a introduction by Senator Romeu Tuma and a Preface by Minister Nancy Andrighi, from the Superior Court of Justice, with her peculiar generosity asserted that “the idealism and the dedication young Professor Henrique Miranda Savonitti turns him into an example of true calling of the new generation of jurists who, work hard on the research and forget to share with others one of the most important values mankind which is knowledge”.

And, drawing attention to the importance of the research work carried out by the author was the improvement of the legislation on the subject, Minister Nancy Andrighi stated that “the procedures for bidding, in particular, are examined one by one, with particular emphasis on trading. The author, a pioneering of a visionary, long before the advent of Law n° 10.520/2002, called attention to restriction applicability problems with the latter type of bidding (trading) in the federal sphere. His criticism, saying the trading session should be extended to four internal legal systems, was established by the aforementioned legislative amendment. With the same shrewdness and relevance, the author follows his studies on the stages of the bidding process and the chances of revocation, invalidation and withdrawal of the bid (…)”.

In fact, Professor Henrique Savonitti was one of the first to write about the Provisional Measure n° 2.026/2000, the one that created the trading, discussing its main fundaments and pointing out the problematic aspects. When the conversion project of the MP was carried out in the Senate, he had the opportunity to offer his contribution to the improvement of the text, which is believed to have assisted in the device change, enabling the expansion of the use of trading to the four federative orders, namely, Federal, State, Federal District and Municipalities.

Currently in its 4th Edition, also published by the Senate, the work includes the analysis of Federal Law n° 11.079, of December 31st, 2004 establishing the bidding and hiring rules of public-private partnerships, as well as detailed considerations on the electronic trading session.
